Dieser Workshop richtet sich in erster Linie an Veranstalter:innen in Österreich und will zur Förderung von Mobilität und Diversität beitragen, sowie die Vernetzung von Veranstalter:innen fördern. Staaten, welche nicht EU-Mitglied, EWR-Staaten oder Vertragspartei der EU sind, werden als Drittstaaten bezeichnet. Die Schweiz kann man als privilegierten Drittstaat betrachten. Schweizer:innen haben infolge des Freizügigkeitsabkommens EU/Schweiz ein vergleichbares Freizügigkeitsrecht wie alle anderen Unionsbürger:innen. Andorra, Monaco, San Marino und Vatikanstadt sind Euro- aber Nicht-EU-Staaten und daher Drittstaaten. Es wird unterschieden zwischen positiven und negativen Drittstaaten: Positivstaatler dürfen sichtvermerksfrei, d.h. ohne Visum für bis zu drei Monate in den Schengenraum einreisen. Negative Drittstaaten brauchen für ihre Einreise ein gültiges Visum.
Was muss ich als Veranstalter:in aufenthaltsrechtlich beachten und berücksichtigen? Welche Zeitläufe sind für die Beantragung von Visa und Aufenthaltstiteln notwendig und was ist hilfreich? Wann wird eine Arbeitsgenehmigung gebraucht? Welche Ausnahmebestimmungen gibt es? Was ist steuerlich zu beachten? Diese und weitere Fragen werden im Rahmen des Workshops behandelt.
Dieser Workshop wird von Sabine Kock und Peter Marhold geleitet und ist eine Kooperation von Art-Mobility Austria und Helping Hands.
Dr.in Sabine Kock ist freischaffende Philosophin und Kulturwissenschaftlerin und berät im Rahmen von Art-Mobility Austria Künstler:innen in Agenden internationaler Mobilität. Ihre Schwerpunkte sind Erkenntnistheorie, Ästhetik, Diskurse des Gedenkens, Gender & Diversity, Neue Formen von Arbeit & innovative Cooperativen. Sie ist Teil der Arge UNESCO Austria und des internationalen Platform Coop Consortium Netzwerks.
Dipl.-Ing. Peter Marhold MBA ist Mitbegründer der in Zusammenarbeit mit der ÖH entstandenen NGO Helping Hands, die zu Fremdenrecht berät und ist seit Beginn in die Beratung involviert. Seit 2018 ist er weiterhin für die Beratung von Studierenden der ÖH Bundesvertretung zu aufenthaltsrechtlichen und Visa-Fragen zuständig.

Praxis Konkret: Working with artists from so-called third countries

This workshop is primarily aimed at organizers in Austria and aims to contribute to the promotion of mobility and diversity, as well as to promote networking between organizers. Countries that are not EU members, EEA states or contracting parties of the EU are referred to as third countries. Switzerland can be considered a privileged third country. As a result of the EU/Switzerland Agreement on the Free Movement of Persons, Swiss nationals have a right to freedom of movement comparable to that of all other EU citizens. Andorra, Monaco, San Marino and Vatican City are euro states but non-EU states and therefore third countries. A distinction is made between positive and negative third countries: Positive third-country nationals may enter the Schengen area without a visa, i.e. without a visa for up to three months. Negative third countries require a valid visa for entry.
What do I have to consider and take into account as an organizer in terms of residence law? What timeframes are necessary for applying for visas and residence permits and what is helpful? When is a work permit needed? What exemptions are there? What do I need to consider for tax purposes? These and other questions will be addressed in the workshop.
This workshop will be led by Sabine Kock and Peter Marhold and is a cooperation between Art-Mobility Austria and Helping Hands.
Dr. Sabine Kock is a freelance philosopher and cultural scientist and advises artists on agendas of international mobility within the framework of Art-Mobility Austria. Her focus is on epistemology, aesthetics, discourses of remembrance, gender & diversity, new forms of work & innovative cooperatives. She is part of Arge UNESCO Austria and the international Platform Coop Consortium network.
Dipl.-Ing. Peter Marhold MBA is co-founder of the NGO Helping Hands, which was founded in cooperation with the ÖH and advises on immigration law, and has been involved in consulting since the beginning. Since 2018, he has also been responsible for advising students of the ÖH Federal Representation of Students on residence law and visa issues.
